UK High Court Throws Out BCA Super-casino Challenge
The British High court has today dismissed a challenge by the British Casinos Association (BCA) to government plans to build a new wave of Las Vegas-style casinos in the UK.
The BCA, which represents 90 percent of casino operators, had sought a review of the government's new gambling policy, arguing that plans for a 5,000-square-metre Super-casino and 16 other large casinos could cost existing casinos up to £120 million a year in lost profits and force many out of business.
Senior judge, Mr Justice Brian Langstaff, dismissed the challenge, saying that the arguments had failed.
According to reports at Hemscott, Mr Langstaff said, “No challenge can be brought against the government simply for adopting a particular policy in respect of the control of gambling, although inevitably any such policy will advantage some, and disadvantage others. Policy on gambling is for the executive, subject to Parliament, and is not intrinsically open to legal challenge.”
