Denmark Considering Its Own UIGEA Legislation
According to numerous media reports, the Government of Denmark could be preparing legislation prohibiting online gambling similar to America’s Unlawful Internet Gambling Enforcement Act (UIGEA).
Although no official statement has been made by the Scandinavian nation, legislation including provisions hampering financial transfers could be proposed as early as this week contradicting European Union legislation on the free movement of trade and services.
The European Commission has already investigated the Dane’s gambling monopoly and issued a ‘reasoned opinion’ against it. The Commission found that the Danish Pools and Lottery Act is incompatible with existing rulings and stated that measures taken by the nation restricting the free movement of sportsbetting services were not necessary or proportionate. Under the Act, only State-owned Danske Spil may lawfully offer games, lotteries and bets and is also the only body allowed to arrange for participation in such games from any other organisation
“If there is no satisfactory reply within two months, the Commission may refer the matter to the European Court of Justice,” read the Commission’s findings.
